Terms and Conditions of Contract of the MOGU Platform

These terms and conditions regulate the access and use of the MOGU platform, property of MoguPlatform, S.L., a software specialized in travel management for travel agencies, which facilitates the presentation and collection of reservations through a subscription system. By contracting and using MOGU, you, hereinafter "THE AGENCY", agree to the following terms:

1. Object of the Contract

‍MOGU
is a technological tool that allows travel agencies to manage their travel submission and collection operations through an online platform. The service includes the possibility of integrating a POS (Point of Sale Terminal) so that THE AGENCY receives funds directly into its bank account. MOGU does not act as an intermediary, operator or agent of the trips offered by THE AGENCY. MOGU is not responsible in any case for the organization, execution or quality of the trips offered by the travel agencies.

. Subscription Plans

‍MOGU
offers subscription plans that can be contracted on a monthly or annual basis. Access to the platform's functionalities and technical support will depend on the subscription plan contracted. The rates and conditions associated with each plan are published on MOGU's official website and can be modified with 30 days notice.

3. Cancellation of the Service

‍THE
AGENCY can cancel your subscription at any time, without penalties. Once cancelled, you will have access to the platform until the end of the active billing period. Before canceling, THE AGENCY can download all its content in PDF format. After the end of the subscription, the access to the platform and its content will be restricted, and MOGU will not guarantee the storage of the data.

4. Responsibility for the Trips

‍MOGU
only provides the technological infrastructure for the management of the trips and collections. It has no responsibility for the organization, fulfillment or any aspect related to the execution of the trips offered by THE AGENCY to its customers. THE AGENCY is solely responsible for the contractual relationship with its travelers and for compliance with all applicable laws and regulations.

5. Data Ownership and Responsibility

Data Ownership:
THE AGENCY owns and is responsible for all data entered and managed on the MOGU platform, including customer, travel, booking and payment data. MOGU only acts as a data processor to provide the contracted service.

‍Data processing: MOGU is committed to protect the personal and business data of THE AGENCY as stipulated by the General Data Protection Regulation (GDPR) and the Spanish data protection laws. The data will be processed only for the provision of the service and will not be shared with third parties without the consent of THE AGENCY, except as necessary to comply with legal obligations.

‍Data storage: During the term of the subscription, the data will be available to THE AGENCY on the platform. In case of cancellation, THE AGENCY will have the option to download your data before the end of the service.

Assistance and Support Level

‍The
technical support and assistance will depend on the subscription plan contracted by THE AGENCY. MOGU offers different levels of service depending on the plan (monthly or yearly) and the features associated to each one, which are detailed in the platform website.


7. Updates and Maintenance

‍MOGU
may make unannounced updates and upgrades to the platform to improve performance or introduce new features. These updates will be done automatically and will not require any intervention by THE AGENCY. MOGU undertakes to notify in advance of any service interruption for maintenance purposes.

8. Modifications to the Terms and Conditions

‍MOGU
reserves the right to modify these terms and conditions. In case of changes, THE AGENCY will be notified with 30 days notice. If THE AGENCY does not agree to the modifications, you may cancel your subscription before the new terms become effective.

9. Limitation of Liability

‍MOGU
shall not be liable for any direct or indirect damages arising from the use of the platform, including service interruptions, loss of data, or technical problems. MOGU does not guarantee that the platform is free of errors or failures, although it undertakes to resolve any technical incident within the stipulated times according to the contracted subscription plan.

10. Jurisdiction and Applicable Legislation

‍This
contract is governed by Spanish law. Any dispute arising in connection with the use of the MOGU platform will be resolved by the courts of Granada, Spain.by subscribing to MOGU, THE AGENCY accepts the terms and conditions described.
